Given that the lawless gibberish of his opinion clearly has no validity, various theories have been floated to explain Roberts’s treachery. The most likely to be true is the most obvious — and also the most alarming. Beltway political culture is completely dominated by left-wing oligarchical collectivists who shower adulation upon moonbats and scorn upon patriots. Weaker souls (e.g., the damp mouse David Souter) sell out to it.

If this is what happened with Roberts, disaster has struck. The far left now has five votes of nine in the ruling junta. We are down to our last defense against tyranny — what George Washington called the people’s liberty’s teeth.

    Very disappointing. I wonder if they have something on the guy. The decision doesn’t make any sense at all. I think that even Obama is shocked that it passed.

    He’s calling them like he sees them, balls and strikes people. Actually, one interesting analysis is that his decision was a very conservative one. He argued that the individual mandate should not be permitted under the commerce clause. He instead classified the potential penalty for not having insurance as a tax, which is constitutional.

    So, while allowing this law to stand, he has in fact shut the door on the expansion of congressional powers via the commerce clause.

    Thanks to Chief Justice Roberts, there is virtually no rational limit to the federal government’s power to coerce us to do what we, as formerly free men and women, would otherwise choose not to do. Roberts put an arrogant and flippant spin on his twisted expansion of federal power. According to him, the federal government is still limited in what it can tell you to do but it can ALWAYS tax you if don’t do as they command and put you in prison if you don’t pay the tax. Of course, there’s no limit to how draconian the tax can be.

    This is the perfect example of why you shouldn’t trust or put any faith into mankind. He is capable of being compromised and can stick the knife in your back when you least expect it. Having been appointed by Bush, the very one who gave us the Patriot Act, really should tell you something about this man. He’s a ‘good boy’ and simply following orders of the real demons in charge of this country. We have nobody to represent us or stand up for us. I hope you see our government for what it is, a MONSTER, and it will never leave you be….

    I actually think Roberts opinion was a very masterful slap to leftist politicians. He defined the commerce clause and ripped it out of the hands of the perverted congress, made Obamacare’s repeal a positive Republican issue (a damning thorn for Democrats and Lil’ Barry!). And, alerted the American people to pay close attention to whom they send to Washington. Now it is the people’s turn to tar and feather statist politicians at the polls – then prepare the beam on which to ride them out of town!

    4th Estate, we get that you are a Leftist who favors expansive government as the instrument for all your social engineering schemes. But can you not see that it is anything but “calling balls and strikes” when a judge rewrites statute on behalf of the legislature? The Act was not written to use taxation as the vehicle of the individual mandate, it was written to use the Commerce Clause to compel the purchase of insurance. When a judge looks at something like that and says “Oh surely you didn’t mean that, let’s do it like this instead” it is not remotely umpiring.

    The ironic thing is that you Leftists are always so keen to be the architects of the very machinery that will be your own end. It has happened to your ideological bedfellows throughout history.

    I do not condone judicial activism, which includes, among other things, legislating from the bench. Roberts has merely ripped the veil of lies woven by the Democrats and called this “abominable act” what it is – a bunch of stealth taxes (see here).

    My initial reaction (knee-jerk, if you will) was quite similar to most of those expressed on these threads. But that was before I began to read the opinion, before I understood both the complex dynamics of the situation and the actual meaning and intent of Roberts’ opinion.

    My advice to all is to put aside their anger and actually take some time to carefully and thoughtfully read through the opinion.

    The problem is there was no perfect outcome here – if Roberts had gone the other way there would have been adverse consequences too. One way to wake people up is to force them to realize what they’re doing. This will force us to realize that the slow side to socialism is real and dangerous and must be addressed, now.

    A little pain can be a motivator – at least that’s the way I see it.

    Would I have rather the decision went the other way?

    Of course!

    But this, hopefully, will help wake up the zombies who allowed Obama to be elected by being apathetic and uninvolved.

    The ball is now in the Republicans’ court. They’ve already scheduled a repeal vote on July 11. Once before the Democrat-controlled Senate was able to scotch the effort by threat of filibuster. Had the mandate stood as mandate they could do so again. But now that it’s a tax, it can be passed by a simple majority. And if it is, the president will be forced before the election to veto a repeal of a law a majority of the voters keep indicating they want repealed.

    Maybe Roberts has made one of the slickest judicial/political moves in decades. Maybe not. The jury (pardon the pun) is still out…but if the Repubs can’t make hay out of THIS, they deserve to lose.

    In a previous thread at this space I started to slowly share some thoughts on the obamacare decision with you. Here I will continue that. Note that, like many of you, I was initially enraged and am now more or less bitterly disappointed that obamacare was allowed to stand. But there is a method to Roberts’ seeming madness, if you bother to calm down and consider things rationally as I believe I am beginning to do.

    Note that his underlying message is that he’s not going to be around forever and the only way to roll back advancing moonbattery is for us to wake up and start dealing with the messes we allow, by our election apathy, to come into being. I think he also gets it that this decision will light a fire in the bellies of some, at least, encouraging them to get more active, more involved, in making sure we clean up Congress and never again elect a complete loser like Obama. Because that is what it’s going to take.

    Rogers handed us a bitter pill and is forcing us to swallow it – but he’s really only waking us up to the fact that our Constitution is ours to lose and – because of our own failure to guard and protect it – that is exactly what is happening. Sure he looks like a rat right now, but I think, in time, we may have a new and more reasonable understanding of what he did – and why.

    Leading up to page 24 of his decision Roberts writes, correctly, that legislative actions and related judicial decisions have been slowly increasing the power of government. He focuses on the Commerce Clause due to the attempt to use and enlarge it in this case, outlining the idea that some believe it provides a path to unlimited government power perhaps, but then he slams that door shut, hard, on that thought, starting on page 24 with this:

    “…Congress has never attempted to rely on [the power given to it by the Commerce Clause] to compel individuals not engaged in commerce to purchase an unwanted product. Legislative novelty is not necessarily fatal; there is a first time for everything. But sometimes “the most telling indication of [a] severe constitutional problem… is the lack of historical precedent’ for Congress’ action.”

    He goes on to point out that while the Constitution grants congress the power to ‘regulate Commerce’, this presupposes existing economic activity which is for some reason in need of regulation. He points out, correctly, that, “If the power to ‘regulate’ something included the power to create it, many of the provisions in the Constitution would be superfluous.” Note, too, that where the Constitution allows for both the creation and regulation of something, as with money, both are mentioned. The Constitution expressly gives Congress the power to create (coin) and regulate money.

    Roberts continues by pointing out, in part in answer, apparently, to a false argument attempted by Ginsberg, to point out that where the Framers intended Congress to be able to compel action they specifically granted such powers to compel – this is in line with the clear intent of the Constitution to be a limiting document, not a grant of universal, unlimited power. The idea here, which socialists and statists hate, is that government only has the power we give it or allow it to take. Listen – Roberts is letting us know that we got ourselves into this mess and if we don’t wake up there’s nothing he or any court can do to get us out – it will only get worse!

    The truth of the Constitution being a document that limits power is something “liberal”/”progressive” moonbats do not understand. They seem to think of the Constitution as something completely different or, more accurately, they attempt to use all branches of government to make it so, but they do so improperly and illegally.

    Roberts is pointing out to us that the fix isn’t for him to undo what we’ve allowed Congress and Obama to do. The fix is to clean up Congress and the White House because, at the end of the day, the Supreme Court is just one of three EQUAL BRANCHES OF GOVERNMENT and it cannot fix the rot we’ve allowed to creep into the other two branches – THAT IS UP TO US!
