People can play house any way they wish, but biology is still biology. Fathers are fathers; mothers are mothers, and those they play house with will abandon them in the end.
If this had been a hetero couple who had fertility issues and had to have a donor to have kids I think this would have been immediately thrown out of court even if the donor had been a close friend.
