Feds Force Private Businesses to Give Hiring Priority to Criminals

For anyone who doesn’t get it yet that the federal government is the enemy of any productive, decent, law-abiding American, this story ought to help:

Should it be a federal crime for businesses to refuse to hire ex-convicts? Yes, according to the Equal Employment Opportunity Commission, which recently released 20,000 convoluted words of regulatory “guidance” to direct businesses to hire more felons and other ex-offenders.

The ruling kakistocracy is made up of reprobates who live by a criminal creed of coercion and theft. That they look out for their fellow malefactors is hardly surprising.

Typically, they frame the issue in terms of their racial caste system, which places despised Caucasians at the bottom.

In the late 1970s, the EEOC began stretching Title VII of the 1964 Civil Rights Act to sue businesses for practically any hiring practice that adversely affected minorities. In 1989, the agency sued Carolina Freight Carrier Corp. of Hollywood, Fla., for refusing to hire as a truck driver a Hispanic man who had multiple arrests and had served 18 months in prison for larceny. The EEOC argued that the only legitimate qualification for the job was the ability to operate a tractor trailer.

Businesses are not allowed to count being likely to refrain from stealing whatever is inside the trailer as a job qualification.

The EEOC has proclaimed that “criminal record exclusions have a disparate impact based on race and national origin.” That means if two people want a job, one a criminal and the other responsible and law-abiding, you had better hire the criminal if you don’t want to be crushed by a lawsuit.

Though blacks make up only 13% of the U.S. population, more blacks were arrested nationwide for robbery, murder and manslaughter in 2009 than whites, according to the FBI. The imprisonment rate for black men “was nearly 7 times higher than White men and almost 3 times higher than Hispanic men,” notes the EEOC.

The solution to this tendency toward sociopathic behavior on the part of liberals’ Chosen People is obvious: punish those who do not break the law.

Former EEOC General Counsel Donald Livingston, in testimony in December to the U.S. Commission on Civil Rights, warned that employers could be considered guilty of “race discrimination if they choose law abiding applicants over applicants with criminal convictions” unless they conduct a comprehensive analysis of the ex-offender’s recent life history.

Please, I just want to hire somebody who won’t steal my truck…

The EEOC is actually demanding that Freeman Companies “pay compensation to rejected job applicants who lied about their criminal records.”

In a statist utopia, everything is either mandatory or forbidden — except when it is both:

The biggest bombshell in the new guidelines is that businesses complying with state or local laws that require employee background checks can still be targeted for EEOC lawsuits. …

As Todd McCracken of the National Small Business Association recently warned: “State and federal courts will allow potentially devastating tort lawsuits against businesses that hire felons who commit crimes at the workplace or in customers’ homes. Yet the EEOC is threatening to launch lawsuits if they do not hire those same felons.”

Characteristically of liberals, EEOC bureauweenies drip with hypocrisy — or is this just obamunist transparency?

At the same time that the EEOC is practically rewriting the law to add “criminal offender” to the list of protected groups under civil-rights statutes, the agency refuses to disclose whether it uses criminal background checks for its own hiring.

As for the professed goal of serving sacred minorities at the expense of white job applicants,

The EEOC is confident that its guidance will boost minority hiring, but studies published in the University of Chicago Legal Forum and the Journal of Law and Economics have found that businesses are much less likely to hire minority applicants when background checks are banned. As the majority of black and Hispanic job applicants have clean legal records, the new EEOC mandate may harm the very groups it purports to help.

As always, Big Government assumes no responsibility for the havoc it inflicts.

Naturally, the EEOC will have no liability for any workplace trouble that results from its new hiring policy.

At least the eagerness of our liberal rulers to punish the law-abiding by giving de facto hiring priority to criminals helps us make sense of their jihad against the Second Amendment. It’s not that they don’t understand that gun laws only affect the law-abiding. It’s just a question of whose side they are on.

Obviously, in a free country a private business would be able to hire whoever it finds most suitable for the job without fear of punishment. Equally obviously, it is not easy to do business in a tyranny run by lunatics. This is why our standard of living will continue to decline so as long as liberals are in charge.

    This is actually no new at all. The codification maybe but the pressures have been in place for awhile.

    My friend, a former VP at Verizon was simply not allowed to hire white men. If he were to make that mistake, he had to submit paperwork documenting six minority candidates that he interviewed and detail why that evil white man who surely was a racist was a better candidate than all those poor minorities whom he wasted their time interviewing for a position that he was intent on giving to an evil white man and jeopardize Verizon in a EEOC lawsuit.

    He told me that it was stacked against hiring a white man that he wouldn’t even interview them because the paperwork was so onerous and the company’s directive so prejudiced.

    Why would it be much of a stretch to give preference to a criminal?

    Living in NY, this is the reality of the labor environment. If you are a white male and not of any special status, such as homosexual, the hiring deck is so stacked against you that you will watch minorities whom you went to school with and who could not even break 750 on the old SATs become senior managers at Chase when you wouldn’t even be given an interview.

    The bottom line here is very simple. The weaker (more quiet and gullible) the people become, the more aggressive this govt. will become, and the more oppressed the people will be. We have a Marxist govt. in place that is totally out of control. Yet, we see no push-back from the sheeple. In fact, looking at the results of the last election, the people were apparently saying they don’t mind being abused.

    With modern science and technology in the medical field and with so many doctors performing sex change or gender realignment or whatever PC term they use. I can see a day where a person can simply change not only there sex but color and facial features and with stolen IDs or birth certificates and become whatever precious protected class necessary to obtain whatever job desired. When my wife was looking for job recently I told her if necessary to lie about her sexual preference i.e. claim to be lesbian and say she was living with her long term partner who was post op sex change male i.e. ME and that we have a adopted special needs child at home. She found a job without having to resort to this type of fraud but hell in Obama’s Amerika I take nothing off the table.

    Just put your name, address and social security number onb the job aplication. NOTHING ELSE. If the interviewer asks for details, just smile and say that you’re trying to avoid a RACIST response.

    By the way, recently at work we assembled for an insureance offer and we were given pamplets from the company. Since there were several Mexican and Caribbean folks there, the presenter asked if anyone needed Spanish language books. Immediatly, I threw up my hand and said “I’m of IRISH deccent, I need one in GAELIC”. My friend Tony then asked for one in ITALIAN.

    So many things allegedly impact coloreds unfairly. At least that’s what the collaborators claim. The truth is that coloreds choose to commit crimes. It isn’t because of the economy. It isn’t because of lack of opportunity. They feel they’re special and laws don’t apply to them.

    This phenomenon that the thread excellently details is also present in the debate in my state over repealing stand your ground law. Here in FL more coloreds are justifiably homicided by homeowners defending themselves. Coloreds claim it’s racist. It isn’t. It’s the consequence of more coloreds being home invader types or committing other violent crimes in a state where law abiding citizens of all races are allowed guns to protect themselves.

    Some professions disallow having a felony on your record. For example try to apply to your local police department for an IT job. I applied to a local police department and had a twenty two page form to fill out. Adult felony convictions, any misdemeanor or felony conviction while employed in a criminal justice and/or law enforcement capacity or any domestic violence conviction will be an automatic disqualification.

    I wonder how long it will be until police and governmental high security locations start getting sued.

    A family member had a felony when they were 18 years old. They then went to college, got a degree and went on with their life after completing parole and never offended again in nearly 30 years. They went through a legal process to have their record “set aside” to make it not appear on all but the most extreme background check. There is a difference between a youthful mistake that a person paid their debt to society for and a habitual offender- like the truck driver that this story is about. If a person is truly sorry for their crimes and is willing to do anything to stay out of trouble that is one thing. Forcing an employer to hire someone who may steal, use drugs or assault another employee or customer is quite another. Let employers be the one to judge people on their merits or lack thereof and keep the government out of everyone’s business. BTW- most states limit background checks to 7-10 years. In all likelyhood if someone doesn’t offend in that length of time they are probably rehabilitated.

    Here is a job some aspiring entrepreuer can offer some ex-cons to give a boost minority ex-con hiring – create a database to thoroughly document all members of the EEOC, where they live, whether they have guns in their house, where they shop, go to school, when they come and go from their homes, where they bank, … and then share it with their friends on facebook. Actually third worlder’s can create the database, and the ex-con’s job can be to review it before sending it out. Think of it as a new jobs initiative, and it will create new opportunities among the criminally unemployed.

    Jacquelin Berrien, head of the Commission, is a black ex-NAACP lawyer who was program officer of the Ford Foundation Peace and Social Justice Foundation. She is married to Brooklyn social activist and community organizer Peter M. Williams, who once authored a report, “Why New York is Falling Behind in Food Stamp Registration.”

    Chai Feldblum is a progressive author and activist for disability and LGBT rights. (This is good, otherwise disability payments might skyrocket and LGBT issues might take on inordinate import in American life).

    In 1993 she was the legal director for the Campaign for Military Service, a group which lobbied to overturn policies forbidding gay and bisexual people from serving openly in the U.S. armed forces. More recently, she was the lead drafter of the Employment Non-discrimination Act, which would prohibit employment discrimination based on someone’s real or perceived sexual orientation (I thought I was a woman but my mustache has me confused – can I use both bathrooms – hire me anyway).

    Victoria Lipnic is a lesbian law professor who campaigns for LGBT issues.

    One commissioner position was vacated Jan. 30, 2013, leaving the fourth position filled by lone Republican appointee Constance Barker, the only chicken left in a coop of foxes.

    If they are not homosexual, black, or driven by hypocrisy and a Communist Manifesto, they will not be chosen – or they will be terminated – by the most despicable unholy president in American history.

The HR dingbat told me to my face that her boss asked her the previous year why they couldn’t have gotten a more d-i-v-e-r-s-e group of new hires. Being a straight able-bodied white male, and smart enough to wonder if this was an invitation for me to make some unwise political remark, I sat in the chair and stared at her. Just. Stared. At. Her.

    A week later I was called and told I didn’t get the job. I asked twice for a reason and was given none. In fairness there were black and female applicants with decent credentials, and I wonder if I’d really enjoy WORKING for such a company.

    Best bet: don’t advertise jobs. Ever. Hire friends-of-friends or friends-of-coworkers. Of course, somebody once told me that most job interviews are hokum anyway. EEOC requires companies to interview the public strickly as window-dressing to prevent lawsuits. True?

That is what they mean by ” You didn’t build that!” Since life is not fair yet and there is no difference between any two people on earth, you are now required to hire the first person who walks, rolls, or crawls in your door.
