Nullification in Alaska

Resistance to the hard left’s ongoing power grab grows:

HB 83 clarifies in Alaska Statute that a federal statute, regulation, presidential executive order, or secretarial order that is not properly adopted or is unconstitutional does not preempt state law. The Attorney General will continue to review and report federal statute, regulation, presidential executive order, or secretarial orders that appear to have not been properly adopted. Under HB 83 those reports will be forwarded to the legislature for consideration.

HB 83 presumes Alaska Legislative interest in an important legal process called “nullification”. Nullification is when a state ‘nullifies’ a federal law, proclaiming it to be void and inoperative, or ‘non-effective’ within the boundaries of that state. In other words it is not a law as far as that state is concerned.

Applications to ObamaCare and gun-grabbing initiatives are obvious.

The Founding Fathers intended the states to serve as a bulwark against federal tyranny. If this bulwark fails, there will be little to prevent Democrats from imposing collectivist totalitarianism.

Progressives are pushing toward the end game. At this point, any inch they are allowed to take could prove fatal to liberty. Kudos to Alaska for showing the resolve to hold the line.

    No, there’s one more thing, and it involves the patriotic citizens and a certain Amendment to the Constitution. And at the rate the patriotic citizens are buying guns and ammo, that “one thing” may happen very soon.

    I moved to a blue state with my job – effing union thugs and slugs under every rock – and I don’t see them joining with Alaska anytime soon. They are much more likely to join with NY, MO, CO, CA …

    Right with you Laurie. I can tell you one thing, the progs I know are VERY upset and nervous about all those American citizens availing themselves of that particular Constitutional amendment. They could care less about gangs or drug dealers or “civilian security forces”.

    It’s the honest, hard-to-corrupt, hard-to-lie-to free man that scares the sh*t out of them. Maybe it’s ’cause they know which side of history they’re really on.

    Only two roads “into” AK and those mountain passes are easily blocked. Only other way is in through ports. Good luck with THAT Obama! haha.

    God bless Alaska and this effort. But we need one another to beat Obama – unity is crucial.

    I see a shift in the winds anyway.

    The media is getting pissed, Obamacare is being dumped by the states, blacks are feeling edgy, Obama is appearing too cocky, the administration’s errors are growing exponentially, the military is balking, the job market is still weak, states are fighting gun control w/legislation, conservative states are showing headway and liberal states are slacking, unions have lost power, the media is catching on to the hellish black violence………ah hell, the list is too long.

    Suffice to say, the actual conservative victory in the last election is beginning to play out in positive and unexpected ways….

    Hopefully, we won’t need as much ammo as we thought – but don’t let your guard down.

    the supreme court does not yet realize that it has nullified its position by nullifying its oath backed task!

    ie. if your job is to protect the constitution and interpret it based on that, and your pay is from and of the people, and you do not protect it. then dont be surprised when states decide to make laws that put you under them, and their own judges above yours.

    which is what Alaska has done here

    a simpler way to put it is, if you do not serve the people that employ you, they wont employ you, they will negate you while you still may get a salary, a robe, and title. but figurehead is what the people decide, when leader is the wrong word

    Thank goodness thereis one state that is ‘taking a stand’ against E.O.’s (Executive Orders).
