Woman Walks Into Door, Sues for $1 Million

When the combination of ever more picayune bureaucratic micromanagement and relentless lawsuits by a locust swarm of greedy lawyers finally ushers in utopia, it will be a place with no glass doors, lest the oblivious walk into them:

A Queens woman is suing Apple for $1,000,000 after smashing her face on a glass door at a Long Island Apple Store.

Evelyn Paswall, 83, claims that the glass doors at the front of Apple Stores pose a risk to the elderly. …

As of Saturday warning strips had been posted on the glass at Apples Manhasset store.

What if Evelyn Paswall wants to stick her head out to see if the lawyer is coming with her free money and she bumps her noggin on the glass before realizing that the window is closed? Maybe they should pass a law requiring all glass to be criss-crossed with warning strips, lest lawsuits destroy the window industry.

    Perhaps she should also sue Windex for making the glass doors (to quote an old ad catch phrase) “so clean they seem to disappear.”

    Should we just ban humanity, lest it get in the way of Mrs Paswall and her ambulance chasing lawyers way ?

    This story has so few facts, it is ridiculous to pass judgment. What if the doors failed to open, and being a very elderly woman, she walked right into them? How extensive were her injuries? Did she attempt to settle for medical bills only, and Apple refused? Everyone loooooves to bash lawyers, until they, or their loved ones get injured. (Watch the documentary “Hot Coffee”) Besides, the Constitution guarantees the jury system. If this is really so outrageous, take it to trial and prove the lawsuit is frivolous. This is no different than when a website like this complains that Zimmerman deserves a full investigation before anyone passes judgment on him in the Trayvon matter. Why does a possible murderer deserve a full investigation in your eyes, but not an 83 year old woman? Yeah, I’m a lawyer, and a Libertarian.

    Reminds me of the time an old lady was walking into our church, and I saw that the heavy glass door she had managed to pull open was swinging shut faster than she could move through it, and it was going to hit her. I ran up to grab it, but didn’t get there quite in time, and it almost knocked her over. I was able to stop it swinging all the way though, so she was able to stay on her feet. My reward? A whack in the shins with her cane for making the door hit her because I was “in a hurry”.

    It is probably too much for an 83 year old to process that Apple stores would actually need doors to keep their very desirable inventory from walking off. I am surprised she was traveling alone and unsupervised. Wasn’t an 85 year old raped and murdered just this week?

    Paswall claims that she didn’t realize that she was walking into a wall of glass as she approached the store, and says that she broke her nose as a result of the collision.

    I would say use common sense upon entering a store. Not every door opens automatically. Some require pulling a handle and it appears these doors do indeed have handles. Most people hate lawyers because the majority of them are crooks looking to make a quick dollar. When someone fails to use good judgement and is injured as the result why should they be rewarded for that? And $1 million? Wow, a far stretch if you ask me. Frivelous lawsuit? Absolutely, just like the $1 million payout to the idiot spilling McDonalds hot coffee on their lap. This is nothing more than a dirty lawyer trying to buy the newest Mercedes and more than likely using this old lady as his stepping stone. I hope they get a big fat goose egg as payout. Next time use some common sense when entering a building and stop clogging the courthouses with these ridiculous lawsuits.

    Check your facts. The “idiot spilling McDonalds hot coffee” deserved every penny she received. Here are the facts. Ms. Liebeck was the passenger in a car without cup holders. Her grandson parked the car, and she was holding the coffee cup between her knees, while seated in the passenger seat. As she proceeded to remove the lid to add cream and sugar, the coffee spilled in her lap. The 79 year old woman was wearing synthetic sweatpants that stuck to her skin when the coffee was spilled. She suffered third degree burns to her legs, genital, and buttock area. She had to receive multiple skin grafts. McDonalds had received 700 previous complaints. At the trial it was revealed that McDonalds coffee is far too hot for human consumption. Lowering the temperature would have saved Ms. Liebeck’s legs, and the coffee still would have been too hot. By the way, Ms. Liebeck initially asked for about $20k, which was the cost of her medical bills. McDonalds counter offered $800. The original amount of the jury award for punitive damages was the amount of coffee McDonalds sells in two days.

    Adam I spent 3 years working in a burn ICU and the majority of the cases were due to negligent behavior. This all boils down to what I said about using common sense. Common sense tells me a cup of fresh coffee is pretty damn hot and will cause burns. It also tells me that if I put that cup between my legs I’m taking a risk of burning myself if it spills. When I was a kid I burnt my tongue on hot cocoa and since then I’ve learned to let it cool to a temperature that is suitable for me to drink it. I feel bad for the lady who spilled her hot coffee and was burned just as I feel bad for the old lady not paying attention and running face first into a glass door. My point is people need to accept responsibility for their own actions rather than seeing how much $ they can squeeze from those who have it. Nobody threw the coffee on her lap and nobody slammed her head into the door.

    From what I’ve heard, the burn ICUs have become overwhelmed in recent years with horribly charred idiots whose meth labs blew up on them.

    Presumably, this is being paid for at taxpayer expense.

    2.7 million isn’t chump change.
    It was thanks to a temporary bout of sanity that the judge reduced that to $480,000

    Plus the legal expenses McDonalds incurred.

    The taco I had yesterday from the drive thru at Bills Burritos burned my tongue.
    Plus the grease dropped onto my clean upholstery, which caused me to become distracted and to scratch my car door on a rogue shopping cart.

    AC you’re correct about the cooks. And of course they are getting top notch care on the tax payers backs. I’ve been in the medical field for quite some time now and my blood still boils when I see how much $$$ we waste on what I call a waste of space. The only thing that makes it balance is the pediatrics who’s lives are cut short and even though they understand their spirits are second to none.

    Adam you are a moron, nobody ever should put hot coffee between their legs. 700 incidents? How many cups of coffee did McDonalds serve over that time period? Ten of BILLIONs and they didnt act like morons. She deserved nothing but a lesson in how to treat hot beverages. Nobody wants luke warm coffee.

    Someimes I burn the roof of my mouth with hot pizza, should I sue because they produced the pizza at too high of a temp and didnt let it cool off first? People who get hurt doing moronic things should be thrown in prison if they sue because of their own stupidity.

    The point is that McDonalds was serving coffee at a temperature that would cause third degree burns once it comes in contact with skin. THIRD DEGREE BURNS, REQUIRING SKIN GRAFTS! If they reduced the temperature, it would have caused incidental burns, AND IT WOULD HAVE STILL BEEN FAR TOO HOT TO DRINK! All that woman wanted was her medical bills paid. A jury, of people just like you and me, heard the evidence and determined that McDonalds was negligent. They also applied comparative negligence, and assigned the plaintiff a portion of the blame. Even with assigning her blame, they still found McDonalds was negligent. The whole turning point of this case was the ridiculous coffee temperature, not the spilling of the coffee. Islandlifer, I also was suspect of the pictures at first, except those are accurate. They also show them in the documentary “Hot Coffee.” Everyone is against greedy lawyers, until they are injured. Oh, one last thing. Lawyers don’t make a penny on personal injury cases unless the plaintiff recovers. If everyone is so offended by greedy lawyers, take cases to trial, and defeat “ridiculous” or “frivolous” lawsuits. If it goes to trial, “greedy” lawyer is working for free, unless he wins!

    So they settle
    I say we enact looser pays

    I bought an old house, way too big for me. I made it bigger. I built on it.

    Its too big. There are rooms that I haven’t been into for a long time. I don’t know what to do with them.
    These day I’m afraid to go into some of them.

    I opted to not have children. I shouldn’t think my children would have appreciated someone like me bringing them into the world.

    I have two dogs however. We get along. They’ve never bitten me. I’ve never raised a hand to them.

    I sit in the music room alot but I don’t play much anymore.

    It’s funny, but I can’t play anything new.
