Legal Challenge to Kate Brown’s Dictatorship

Maybe the flood of COVID-19 tyranny has reached its high-water mark. The safeguards that have prevented the USA from succumbing to autocracy for centuries are finally beginning to kick in. Oregon Governor Kate Brown, the quintessential moonbat despot, has encountered at least temporary resistance:

A judge in Oregon on Monday ruled that Gov. Kate Brown’s coronavirus restrictions were “null and void” after the Democratic lawmaker failed to have her emergency orders approved by the state’s legislature in 28 days.

Baker County Circuit Judge Matthew Shirtcliff made the ruling Monday in a lawsuit brought by churches who said the social-distancing directives were unconstitutional.

The suit had also argued that emergency powers only last for a month and after that Brown would have needed legislative approval. The judge agreed.

Sounds like the ruling was a no-brainer. For Brown, appealing to the Oregon Supreme Court was also a no-brainer. Her rule by arbitrary decree has been reinstated for now:

The Oregon Supreme Court late Monday halted a rural judge’s order earlier in the day that had tossed out statewide coronavirus restrictions imposed by Democratic Gov. Kate Brown.

The Supreme Court’s ruling stays Shirtcliff’s decision pending review by all the high court justices. …

In a seven-page opinion, Shirtcliff wrote that the damage to Oregonians and their livelihood was greater than the dangers presented by the coronavirus.

The danger to our system of government could be greater still. Brown’s lockdown is both unconstitutional and illegal. Hopefully, the Oregon Supreme Court is not too liberal to admit it.

There is precedent for pushing back against regional Flu Manchu overlords:

The Wisconsin Supreme Court struck down Gov. Tony Evers’ stay-at-home order last week, ruling that his administration overstepped its authority when it extended the order for another month without consulting legislators.

A federal judge in North Carolina on Saturday sided with conservative Christian leaders and blocked the enforcement of restrictions that Gov. Roy Cooper ordered affecting indoor religious services during the pandemic.

Brown, Evers, and Cooper are all Democrats, just like their fellow coronavirus tyrants Gretchen Whitmer, Janet Mills, Gavin Newsom, Andrew Cuomo, J. B. Pritzker, Phil Murphy, and Tom Wolf. Kung Flu hysteria has confirmed the darkest suspicions regarding the authoritarian tendencies and rank opportunism of the Democrat Party.

It would be nice to think that we will learn from this experience, and that safeguards will be put in place to prevent Democrat governors from assuming the powers of a dictator the next time the media decides there is a crisis. While we are indulging in wishful thinking, it would be nice if people would learn not to vote for Democrats, who love power far too much to be trusted with it.
