Will Democrats Pack the Supreme Court?

Progressives have the advantage of being the bad guys. They won’t let decency, propriety, respect for our institutions, or love of country get in their way. When the media helps them back into power, they may even pack the Supreme Court by adding extra Justices. Some are scheming openly about it:

“Democrats have no choice but to implement structural reforms to the judiciary if they hope to prevent decades of rule by the alt-right in America,” HuffPost reporter Zach Carter claimed in a Thursday article.

“At a minimum, that will mean expanding the Supreme Court bench to 11 justices under the next Democratic president. Other reforms, including term limits to remove aging conservatives, may well be appropriate.”

While we are imposing a banana republic, why not just throw anyone to the right of Vladimir Lenin off the court as soon as Democrats have the leverage?

Jacobin writer Todd Tucker made a similar argument in an essay on Friday, claiming that Democrats need to rig the court in order to pass far left legislation that might otherwise be ruled unconstitutional.

Here’s how the Oxford dictionary defines “Jacobin”:

The Jacobins were the most radical and ruthless of the political groups formed in the wake of the French Revolution, and in association with Robespierre they instituted the Terror of 1793–4.

If radicalized Democrats regain power in their current state of hysterical extremism, comparisons to the French Revolution and the following Reign of Terror could become commonplace.

The idea of packing the court is not limited to the farthest fringes. The New Republic was pushing it even before Anthony Kennedy announced his retirement. CNN’s Harry Enten and Bloomberg’s Steven Dennis have brought up the issue.

They aren’t worried about giving Republicans ideas, because they know conservatives would never do such a thing. Democrats would though. During the outrageously unconstitutional lunacy that kept the Great Depression going, FDR bullied the Supreme Court into abject submission by threatening to pack it with extra Justices. The result was tyrannical rulings like Wickard v. Filburn, according to which the federal government can prevent you from growing food on your own property for your own consumption on the grounds that it might affect interstate commerce.
