In the olden days, trouble with the law counted against jobseekers. Now, it could be a point in their favor. Who would dare fail to hire a criminal if a lawsuit by Courtney McElrath-Bey of Chicago succeeds?

Her lawsuit, filed in February and first reported by Legal Newsline, seeks damages and could expand to cover other applicants who were denied jobs under similar circumstances.
Brace yourself, Target. Here comes another looting spree.
According to the complaint, Target extended McElrath-Bey a conditional offer in October for a job described as an “order picker or warehouse associate” contingent on the results of a background check.
It came to light that she faces charges for robbery and aggravated battery.
Her lawsuit claims Target’s decision violates the state’s 2021 Employee Background Fairness Act, which amended the Illinois Human Rights Act to make the use of criminal history in hiring decisions a civil rights violation in many cases.
Background checks are discriminatory. In liberal utopia, they will be abolished.
In addition to the pending robbery case, Chicago Police Department and court documents show that McElrath-Bey was arrested on December 26, 2025, at a Walmart on the Far South Side.
Walmart accused her of retail theft and criminal trespassing but failed to follow through by sending a representative to court. Now she is Target’s problem. But what goes around will come around.
