Joe Biden has confirmed that he will select a new member to the Supreme Court primarily on the basis of the candidate being a black woman. Thank you, Jonathan Turley, for reminding us that this is not only moronic and wrong but also unconstitutional:

With the court set to rule on racial preferences in college admissions, it raises the question of whether it is appropriate for a politician to use a criterion that the court itself has found unconstitutional for public educational institutions and unlawful for businesses. …

Biden could have learned something from the universities now defending their admissions policies in Students for Fair Admissions v. President & Fellows of Harvard College and Students for Fair Admissions v. University of North Carolina. For decades, universities have avoided the type of outright quota the court held unconstitutional in Regents of the University of California v. Bakke (1978). “Preferring members of any one group for no reason other than race or ethnic origin is discrimination for its own sake,” Justice Lewis Powell wrote. “This the Constitution forbids.”

That’s why Democrats need to control the Court: to guarantee that the Constitution will not be an impediment to their agenda.

Already controlled by liberals, universities systematically discriminate against whites and Asians. At least there, being black is only a major plus, often literally more important than being able to read, but not a requirement for admission.

Biden, by contrast, promised not only to take account of race (and sex) before all other criteria, but to exclude all male or nonblack nominees regardless of their credentials. Similar uses of race—including prioritizing black farmers for pandemic relief—have prompted courts to strike down Biden administration programs as raw racial discrimination.

Biden’s habitual anti-white discrimination aside, the primary qualification is not to be a black woman, but to be a rubber stamp for the radical left. Democrats can find any number of apparatchiks of the Sonia Sotomayor caliber, who wouldn’t know the Constitution from the Sears catalogue, and who can be counted on to always vote to make the Democratic Party more powerful and to impose its ideology, subverting the Supreme Court into a legislative body. Any leftist who holds the Constitution in contempt will do, so it may as well be a black woman, so as to pay obeisance to critical race theory and feminism, the two central pillars of cultural Marxism.
